Your Rights as a Data Subject

First, we would like to inform you about your rights as a data subject. These rights are standardized in Articles 15 - 22 of the EU GDPR. This includes:

  • The right to information (Article 15 EU GDPR),
  • The right to erasure (Article 17 EU GDPR),
  • The right to rectification (Article 16 EU GDPR),
  • The right to data portability (Article 20 EU GDPR),
  • The right to restriction of processing (Article 18 EU GDPR),
  • The right to object to the processing (Article 21 EU GDPR).

To exercise these rights, please contact: datenschutz@kurtzersa.de. The same applies if you have any questions about data processing in our company or if you wish to revoke a consent given. You also have the right to lodge a complaint with a data protection supervisory authority.

Right to Object

Please note the following regarding your right to object:

If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without giving reasons.
This also applies to profiling insofar as it is related to direct marketing.

If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection is free of charge and can be made informally, preferably to: datenschutz@kurtzersa.de

In the event that we process your data to safeguard legitimate interests, you can object to this processing for reasons arising from your particular situation at any time; this also applies to profiling based on these provisions.

We will then no longer process your personal data, unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

Purposes and Legal Bases of Data Processing

When processing your personal data, we comply with the provisions of the EU GDPR and all other applicable data protection regulations. Legal bases for data processing arise in particular from Art. 6 EU GDPR.

We use your data for business initiation, fulfillment of contractual and legal obligations, execution of contractual relationships, offering products and services, as well as strengthening customer relationships, which may also include analyses for marketing purposes and direct advertising.

Your consent to data processing may also constitute a legal permission regulation in data protection law. Before giving consent, we will inform you about the purpose of data processing and your right of revocation.

Disclosure to Third Parties

We will only disclose your data to third parties within the framework of legal provisions or with your corresponding consent. Otherwise, data will not be disclosed to third parties unless we are legally obligated to do so (disclosure to external bodies such as supervisory authorities or law enforcement authorities).

Recipients of Data / Categories of Recipients

Within our company, we ensure that only those persons receive your data who need it to fulfill contractual and legal obligations.

In certain cases, service providers support our departments in fulfilling their tasks. The necessary data protection contracts have been concluded with all service providers.

Transfer to Third Countries / Intention to Transfer to Third Countries

Data transfer to third countries (outside the European Union or the European Economic Area) only takes place if it is necessary to fulfill the contractual relationship, is legally required, or if you have given us your consent.

We currently do not transfer your personal data to any service provider or group companies outside the European Economic Area.

Storage Duration of Data

We store your data for as long as it is needed for the respective processing purpose. Please note that numerous retention periods require that data continue to be stored. This applies in particular to commercial or tax retention obligations (e.g., Commercial Code, Tax Code, etc.).

If there are no further retention obligations, the data will be routinely deleted after the purpose has been achieved. Additionally, we may retain data if you have given us permission to do so or if legal disputes arise and we use evidence within statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

Secure Transmission of Your Data

To best protect the data stored with us against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons, we use appropriate technical and organizational security measures. The security levels are continuously reviewed in cooperation with security experts and adapted to new security standards.

Data exchange to and from our website takes place in encrypted form. For our website, we offer HTTPS as a transmission protocol, each using the current encryption protocols. In addition, there is the possibility to use alternative communication channels (e.g., postal service).

Cookies (Art. 6 Abs. 1 S. 1 lit. a, f EU-DS-GVO, § 25 Abs. 1, 2 TTDSG)

Our website uses so-called cookies. They serve to make our offer more user-friendly, effective, and secure. Cookies are small text files that are stored on your end device and saved by your browser (locally). Cookies only contain pseudonymous, often even anonymous data. Some cookies remain for the duration of a browser session (so-called session cookies), others are stored for a longer period of time (so-called persistent cookies, e.g., consent settings). The latter are automatically deleted after the specified time (usually 6 months). In addition to our own cookies, those controlled by third parties are also used. These use the information contained in the cookies to display content to you or to record the pages you have visited.

Due to our legitimate interest (Art. 6 Abs. 1 S. 1 lit. f EU-DS-GVO), we use technically necessary cookies that are essential for the operation of the website and to ensure functionality. Furthermore, we use cookies without your consent to the extent that their sole purpose is to store or access information stored on your end device for the purpose of transmitting messages or if they are strictly necessary to provide the service explicitly requested by you, § 25 Abs. 2 TTDSG.

Subject to your consent, additional cookies are used that enable us or third parties to analyze how our services are used. This allows us to tailor the content to user needs. In addition, through cookies, we have the ability to measure the effectiveness of a particular advertisement and to place it based on thematic user interests, for example. The legal basis for this is your express consent (Art. 6 Abs. 1 S. 1 lit. a EU-DS-GVO, § 25 Abs. 1 TTDSG).

You can revoke your consent via our consent banner at any time with effect for the future and change the cookie settings. Please note that changes must be made separately for each end device.
